Labor right protection for foreigners in China

The Constitution Law, Labor Law, Law on Labor Contract, Law on Social Insurance, Law on Labor Dispute Arbitration, and Disposal Regulations on Enterprise Labor Disputes all make specifications on labor right protections, these provisions also adapt to foreigners in China. The recruitment, resignation, dismissal, remuneration, welfare, labor protection and labor insurance, etc. for employees of foreign enterprises in China shall abide by these stipulations by means of signing labor contract. The employees shall set up trade union and practice activities to maintain their legal rights in the company. The enterprise shall provide the trade union with necessary conditions. If the foreign-invested company violates regulations and break labor’s right, it shall bear correspondent responsibilities in accordance with Labor Law, Labor Contract Law and Law on Social Insurance.
